A man who spent more than 25 years on death row for the robbery and murder of a woman at an Ohio hotel had his case dismissed by prosecutors. Elwood Jones was released after a judge ordered a new trial in December 2022 due to withheld evidence. Hamilton County Prosecutor Connie Pillich announced the case’s dismissal after a thorough review of evidence and court documents, stating that she was not convinced of Jones’ guilt in the killing of Rhoda Nathan.
Jones had been convicted in 1994 for the murder, robbery, and burglary of the 67-year-old woman from Toms River, New Jersey. The prosecutor’s office, under Melissa Powers, had contested the judge’s decision, leading to a legal battle that was ongoing. However, Pillich decided not to pursue a fresh trial due to the lack of essential evidence, witnesses, and modern scientific techniques.
Pillich’s review highlighted the absence of direct physical or forensic evidence linking Jones to the murder, along with witness statements pointing to other potential suspects that were not properly investigated. Additionally, Jones’ defense team did not receive crucial investigation materials before the trial. Modern medical tests have also cleared Jones as a suspect in the case.
According to police reports, Nathan was killed during a robbery in her hotel room while visiting for a family event. Jones, an employee at the hotel, was on duty at the time of the incident. Pillich plans to establish a Conviction Integrity Unit to address wrongful convictions and unfair sentencing practices.
Jones is the 12th death row inmate to be exonerated in Ohio and the second in Hamilton County. Kevin Warner, from Ohioans to Stop Executions, emphasized the need to address wrongful convictions and the flaws in the state’s death penalty system.
