A recent report from the coroner’s office has determined that the death of a 29-year-old man following an encounter with police was accidental, with the restraint technique employed by officers likely playing a role in the outcome. The incident involving Abisay Cruz occurred on March 30, 2025, in the Saint-Michel neighborhood of the city.
Cruz’s passing, along with the release of footage capturing parts of the altercation, led to public outcry and demonstrations in the area, further straining the relationship between the community and law enforcement. The use of the “hogtie technique,” which involves binding a person’s limbs behind their back while lying face down, was a focal point of the investigation.
According to Coroner Géhane Kamel, Cruz’s death was attributed to a combination of cocaine intoxication and potential positional asphyxia during the police intervention. Kamel highlighted the controversial nature of the hogtie method, noting that it is discouraged and even prohibited by various police and medical organizations due to safety and human rights concerns.
The report emphasized that the restraint method likely played a significant role in Cruz’s demise. It was revealed that Cruz, described as a caring individual with close family ties, was facing deportation to Honduras, adding to his stress leading up to the tragic event.
While police reported Cruz as an immediate physical threat, conflicting witness testimonies painted a different picture, suggesting Cruz was cooperative before the situation escalated. Despite differing accounts, the report acknowledged the perceived threat to both Cruz and those present, leading to the involvement of five officers in subduing him.
Kamel recommended banning the hogtie technique and suggested equipping officers with naloxone kits and body-worn cameras for handling crisis situations. Montreal police expressed their commitment to implementing these recommendations, emphasizing that the hogtie method is not part of their official training curriculum.
The response from emergency medical services was also criticized in the report, citing ongoing service shortages that may have impacted the outcome of the intervention.
