“Government Reviews Transgender Guidance to Prevent Restroom Monitoring”

Ministers are prioritizing the careful review of transgender guidance to ensure it is handled appropriately and avoids situations where individuals are tasked with monitoring restroom use, according to a government official.

Children’s minister Josh MacAlister has acknowledged the persistent nature of the issue as the government evaluates guidance provided by the Equality and Human Rights Commission. The leaked document from the Commission suggests the potential exclusion of transgender individuals from gender-specific spaces based on their appearance.

Mr. MacAlister highlighted the complexity of the guidance, emphasizing its impact on physical infrastructure and the subjective judgment required by staff to determine gender appearances. The aim is to prevent a scenario where restroom access becomes a matter of surveillance.

In a separate development, Women and Equalities Minister Bridget Phillipson expressed her thorough consideration of the watchdog’s recommendations. The EHRC recently urged Ms. Phillipson, who also serves as Education Secretary, to expedite the implementation of the new guidance.

The current code, last updated in 2011, is undergoing revision following a Supreme Court ruling affirming that the terms “woman” and “sex” in the Equality Act 2010 pertain to biological distinctions.

In response to inquiries about the code, Ms. Phillipson emphasized the importance of proper implementation to ensure access to gender-specific services for women in need, such as domestic violence support and rape crisis centers. She also stressed the necessity of treating transgender individuals with dignity and respect in the process.
